Patient responsibilities

To achieve high-quality and safe medical treatment, the patient is obliged to:

  • actively participate in protecting, strengthening and restoring one's own health,
  • During the illness, act in accordance with the professional instructions and treatment plans received, to which he or she has consented orally or in writing,
  • provide the competent doctor and other competent health professionals with all necessary and truthful information regarding their health condition that is known to them and is important for further medical treatment, in particular information about their current and past injuries and illnesses and their treatment, illnesses in their family, any allergies and medications they are taking,
  • inform healthcare professionals about sudden changes in health status that occur during treatment,
  • be considerate and respectful of the privacy and other rights of other patients and healthcare professionals,
  • respect the published schedules, house rules and prescribed organizational procedures of healthcare providers,
  • Inform the healthcare provider in a timely manner about any absence for examination or treatment.

 

In accordance with the Medical Service Act, a doctor is not responsible for the course of a patient's treatment when the latter:

  • provides false information to the doctor about his/her health,
  • does not follow the doctor's instructions,
  • does not participate in protecting, strengthening and restoring one's own health.

NOTICE – Patient Rights Act In accordance with Article 58 of the Patient Rights Act (Official Gazette of the Republic of Slovenia, No. 15/08), we inform you that the following persons have been appointed to receive and process requests for the first review of a violation of patient rights (hereinafter referred to as the first request):

The patient may file the first request no later than 15 days after the alleged violation due to the alleged inappropriate attitude of healthcare professionals or healthcare associates, or within 30 days after the end of healthcare care, if it concerns alleged inappropriate behavior. The patient may file the first request within three months after the expiration of the deadlines from the previous sentences, if he or she learned about the violation later or if the consequences of the violation became apparent later.

The first request is submitted to the competent person of the provider (Article 60 of the Patient Rights Act). The first request, which is made in writing or orally on record, contains in particular:

  • the patient's personal name, residential address and contact details,
  • a description of the alleged violation of the patient's rights,
  • data on participating healthcare workers or healthcare associates,
  • information about any other persons involved,
  • time and place of the alleged violation of the patient's rights,
  • potential consequences of an alleged violation of patient rights and
  • a possible proposal for resolving the dispute.

 

The patient receives a copy of the minutes of the oral request. If it is not clear from the written request who submitted it or if the request is offensive or inappropriate, the request will not be considered. A written note will be made to this effect and sent to the patient, if known. If the written request does not contain all the elements necessary for consideration, the competent person will invite the patient to complete the request within a specified period. If the patient does not complete the request within the period, the request is deemed to have been withdrawn, which the patient will be informed of in the invitation to complete the patient's request.

In accordance with Article 49 of the Patient Rights Act, the patient has the option to authorize a patient rights representative who will provide basic information, offer professional assistance and provide specific guidance in exercising their rights in the field of healthcare,

NOTICE OF REPRESENTATION AND OTHER ASSISTANCE OPPORTUNITIES FROM A PATIENT'S RIGHTS REPRESENTATIVE

According to the Patient Rights Act (ZpacP), a patient (user of healthcare services) has the right to free assistance in exercising his/her rights under the ZpacP. The work of the representative is confidential.

Competences of the patient rights representative:

  • advises and assists the patient or represents him/her in exercising his/her rights under the ZPacP,
  • advises the patient in an appropriate manner about the content of rights, methods and possibilities of exercising them before or during treatment and when they are violated,
  • provides concrete guidelines for exercising rights and suggests possible solutions,
  • provides assistance to the patient in filing legal claims under the ZPacP,
  • makes necessary inquiries on behalf of the patient regarding alleged violations of health care providers,
  • informally mediated with healthcare providers with the aim of quickly eliminating violations,
  • when there is no violation of rights under the ZPacP Act, the patient is referred to a competent legal or natural person or competent state authority,
  • within the patient's authorization, files legal remedies and makes proposals, explanations and other statements on behalf of and in favor of the patient for a quick and successful resolution of the dispute,
  • provides the patient with basic information, offers professional assistance and provides concrete guidelines in exercising rights in the field of healthcare, health insurance and the performance of healthcare activities,
  • the healthcare provider must provide the representative with access to all information necessary for his work in relation to the matter he is handling,
  • The representative may review the patient's medical records based on their written consent (authorization).

 

The patient's representation with healthcare providers is carried out by the representative based on the patient's written authorization.
